1. Service Description
Never Forget is a gift planning platform that provides automated reminders, AI-powered gift suggestions, and purchase links to help you plan and send thoughtful gifts for important occasions. The service facilitates gift discovery and recommendations but does not directly sell, ship, or fulfill any physical or digital products.
2. Reminder Reliability
We make our best effort to deliver reminders on time via email. However, reminders are not guaranteed due to potential issues with email delivery, service outages, or other technical factors. Never Forget should not be used as your sole reminder system. We are not liable for missed occasions due to undelivered or delayed reminders.
3. Gift Purchases & Third-Party Merchants
All gift purchases are fulfilled entirely by third-party partner merchants. When you purchase a gift through our platform, the transaction is between you and the merchant. Never Forget is not responsible for product quality, shipping times, returns, refunds, or any other aspect of the purchase transaction.
4. Affiliate Relationships
We may earn commissions from partner merchants when you make a purchase through our platform. This does not affect the price you pay for any gift. Affiliate relationships are disclosed transparently, and commissions do not influence the ranking or selection of gift recommendations.
5. Pricing & Billing
Creating an account and using the gift planning features is free. We charge a 2% service fee on each gift purchase made through the platform. The minimum budget per occasion is $50, which includes shipping and handling. Billing occurs automatically at the time of purchase. There are no recurring subscription fees.
6. User Responsibilities
You are responsible for providing accurate information about your recipients, occasions, and delivery details. You agree not to use the service for any unlawful purpose or in any way that could damage, disable, or impair the service.
7. Data & Account Deletion
You may delete your account and all associated data at any time via Settings. Deletion is permanent and cannot be undone. We recommend exporting your data before deletion if you wish to keep a record of your gift history and plans.
8. Limitation of Liability
The service is provided "as is" without warranties of any kind, either express or implied. Never Forget shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service.
9. Changes to Terms
We reserve the right to modify these terms at any time. Significant changes will be communicated to you via email before they take effect. Continued use of the service after changes constitutes acceptance of the updated terms.
